Why IAS officers of Delhi, Uttarakhand and Chhattisgarh are “concerned” and “frustrated”. Read IAS Association’s resolutions

IF THE resolutions of a meeting of the executive committee of IAS Association (Indian Civil and Administrative (Central) Association) held on May 25, 2015 in New Delhi are anything to go by, the IAS officers belonging to three states in particular -- NCT Delhi, Uttarakhand and Chhattisgarh – are getting more concerned and frustrated because of the recent trend of posting non-cadre officers to cadre posts, something what the association terms as a “blatant violation” of the IAS (cadre) Rules, 1954 and that it reduces efficiency of the administration. “IAS officers are specifically trained over their career-span to deal with jobs requiring specific background, experience and understanding. en-cadred posts is not only contrary to the statutory Rules but also reduces efficiency in administration”, according to the resolution, a copy of which is available with BoI. Apart from high courts of Punjab and Haryana, Uttar Pradesh and Tamil Nadu, the Supreme Court of India had also ruled that the IAS (cadre) Rules, 1954, are statutory rules and have the force of law and the state governments are bound to follow the Cadre Rules, 1954, according to the Association. “In this regard, the Central Association has received Representation from its constituents in the States of NCT Delhi, Uttarakhand and Chhattisgarh that the above mentioned statutory Rules are being blatantly violated thereby causing lot of concern and frustration in the IAS officers in these States. The Association resolved that if such attempts are not stopped with immediate effect, then the Association would be left with no option but to take legal recourse to approach Government of India, which is the Competent Authority and also to approach the Competent Judicial Forums”, the resolution said.
In the same meeting, the Association also took a few more resolutions.
1. “Resolved to strongly condemn the recent cases of unwarranted and disrespectful treatment meted out to some IAS officers working in Delhi government. 
2. Resolved to express its anguish over character assassination of IAS officers in media, using official machinery, without any substantive ground, thereby tarnishing their reputation. This undignified treatment meted to civil servants is highly demotivating and demoralizing the entire rank and file of the civil service and is clearly unacceptable.
3. Resolved to urge the Hon’ble President of India, the Hon’ble Prime Minister of India, Hon’ble Home Minister of India, the Hon’ble Chief Ministers of States and Administrators of all the UTs to create a conducive atmosphere wherein all Government officers including senior civil servants can function in a free, impartial and dignified manner without becoming victims of political crossfire.”
The association then resolved to “remind all the Constitutional Executive functionaries of the speech by Shri. Sardar Vallabhbhai Patel in the constituent Assembly on 10th October 1949 which was also read out during the meeting”.
Patel  said: “I tell you, do not quarrel with the instruments with which you want to work. It is a bad workman who quarrels with his instruments. Take work from them. Every man wants some sort of encouragement. Nobody wants to put in work when every day he is criticized and ridiculed in public. Nobody will give you work like that. You will not have a united India, if you have not a good all-India service which has the independence to speak out its mind, which has a sense of security that you will stand by your word and that after all there is the Parliament, of which we can be proud, where there rights and privileges are secure”.
